Terms and Conditions

These Terms govern your use of jdaledillard.com (the "Site") and any purchases made through it. By using the Site or placing a pre-order, you agree to these Terms. If you do not agree, please do not use the Site.

1. The Site

Jdaledillard.com is operated by J. Dale Dillard. The Site provides information about my books, accepts newsletter subscriptions, and accepts pre-orders for *The Nuevo Montañas Files: No Safe Harbor* and future titles.

2. Pre-Orders

**Pre-Order Discount.** Pre-orders submitted on or before July 31, 2026 receive a 25% discount off the standard list price. After August 1, 2026, the standard list price applies.

**How Pre-Orders Work.** When you submit a pre-order form, you are not making a payment at that moment. After receiving your form, I will email you a payment link (the "Pay Link") within two (2) business days. To complete your pre-order, you must follow the Pay Link and submit payment. Pre-orders are not finalized until payment has been received.

**Failure to Complete Payment.** If payment is not completed within fourteen (14) days of the Pay Link being sent, your pre-order may be cancelled without further notice.

**Cancellations Before Payment.** You may cancel a pre-order at any time before payment is submitted simply by not completing the Pay Link. There is no charge for an uncompleted pre-order.

3. Shipping (Paperback)

Paperback copies will ship on or shortly after the release date of August 1, 2026. Shipping is currently available within the United States only.

Shipping costs and estimated delivery times will be communicated as part of the Pay Link or by email. Risk of loss and title to the paperback pass to you upon delivery to the carrier. I am not responsible for delays, damage, or loss caused by the carrier.

4. Digital Delivery (Ebook)

Ebooks are delivered as EPUB files by email after payment is received. The ebook is licensed for your personal, non-commercial use only and may not be redistributed, resold, shared, or used to create derivative works.

5. Refunds and Returns

**Paperback.** Refund requests must be made in writing within 7 days of delivery, and the book must be returned in unopened, resellable condition. Shipping costs are non-refundable. The customer is responsible for return shipping unless the book arrived damaged or defective.

**Ebook.** Because the digital file is delivered immediately upon payment, ebook sales are final and non-refundable, except where required by law.

**Damaged or Defective Items.** If your paperback arrives damaged or is defective, contact me at jdd@jdaledillard.com within seven (7) days of delivery and I will arrange a replacement.

6. Intellectual Property

All content on the Site — including the text of the book, cover art, photography, the "Nuevo Montañas Files" name and characters, and any other original material — is the property of J. Dale Dillard and is protected by United States and international copyright law.

You may not reproduce, distribute, publish, transmit, modify, create derivative works from, or commercially exploit any content from the Site without my prior written permission, except for normal personal-use reading of any book you have legitimately purchased.

7. Acceptable Use

You agree to use the Site lawfully and respectfully. You may not:

- Attempt to interfere with, disrupt, or compromise the Site or its security.

- Submit false, fraudulent, or misleading information through any form.

- Use the Site to harass, defame, or harm any other person.

- Scrape, mirror, or republish content from the Site without permission.

I reserve the right to refuse service or cancel any order at my discretion if I reasonably believe these Terms have been violated.

8. Disclaimer of Warranties

The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. I make no guarantee that the Site will always be available, uninterrupted, error-free, or secure.

9. Limitation of Liability

To the maximum extent permitted by law, J. Dale Dillard's total liability for any claim arising out of your use of the Site or purchase of a book shall not exceed the amount you paid for the relevant order. In no event shall I be liable for any indirect, incidental, consequential, or punitive damages.

10. Governing Law

These Terms are governed by the laws of the State of Alaska, without regard to its conflict-of-law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Alaska, and you consent to the personal jurisdiction of those courts.

11. Changes to These Terms

I may update these Terms from time to time. The "Last Updated" date at the top will reflect any changes. Your continued use of the Site after changes are posted means you accept the updated Terms.
